Environment Policy Interest Group

This group is focused on issues including: approval regulations, air standards & air policy & programs, air monitoring & reporting: waste regulation.  An annual joint meeting is held with the Ministry of the Environment and Climate Change which will likely take place this year in September.

Cap and Trade Cancellation Act

The Government of Ontario has posted Bill 4 - The Cap and Trade Cancellation Act for consultation on the new EBR website. The Bill was introduced on July 25th in the Ontario Legislature; if passed it will repeal the Climate Change Mitigation and Low-carbon Economy Act, 2016 (CCMLEA) and set out the legal framework the wind-down of the greenhouse gas cap and trade program including the compensation framework.

The proposed legislation would require the establishment of targets for reducing the amount of greenhouse gas emissions in Ontario. The Minister of Environment, Conservation and Parks would also be required to prepare a climate change plan and to prepare progress reports in respect of the plan.
The Bill itself is in Second Reading in the Legislature. According to media reports it is unclear if the consultation process will be complete before the passage of Bill 4.

With respect to the wind down of the Cap and Trade Program, the matters addressed by the Act include the following:

  1. The retirement and cancellation of cap and trade instruments.
  2. The payment by the Crown of compensation in respect of cap and trade instruments, the amount of which is to be determined in accordance with the regulations. The obligation to pay compensation is subject to various limitations set out in the Act.
  3. Preventing any cause of action from arising against the Crown and specified related persons as a result of various specified matters, including the enactment of the Act and the repeal of the Climate Change Mitigation and Low-carbon Economy Act, 2016.
  4. The extinguishment of any existing proceedings, and the prevention of any future proceedings, against the Crown and other specified related persons, in relation to specified matters.

The Bill has been posted for 30 days, with a deadline for comments of October 11th. As such, CME is looking for input and recommendations from our members so that we can provide appropriate comments to the Ministry of Environment, Conservation and Parks on this legislation. Specifically, we are looking for input based on the following questions below:

  1. Are you supportive of this piece of legislation? Yes or No? 
  2. If you do have concerns with the legislation, what are your specific concerns? 
  3. Do you have any specific recommendations to improve Bill 4? If yes, what are they and what is the rationale behind your recommendations?
  4. We anticipate that the Government of Ontario will move forward with proposing a new climate plan for the province with manufacturing being a significant focus of the plan. As such, what key messages should CME suggest be included in the plan for manufacturers? And what are your specific policy recommendations that you believe should be included in the plan?

Please provide your input to us no later than end of business on Thursday, September 27th.
